Terms of Service

1. Acceptance of Terms
These Terms of Service ("Terms") govern the use of the BrockStar Websites website and the professional services provided by BrockStar Websites ("BrockStar," "we," "our," or "us"). By accessing our website, requesting services, signing a proposal or agreement, or submitting payment, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree with these Terms, you should not use our website or purchase our services.
2. Services
BrockStar Websites provides website design and development, search engine optimization (SEO) setup, and customer relationship management (CRM) and lead-capture integration services, together with related setup and configuration services. The specific services provided for each project shall be governed by the applicable proposal, invoice, agreement, or written communication between BrockStar Websites and the Client. All services are provided on a one-time, project basis unless otherwise agreed in writing.
3. Project Approval
Work shall not begin until the Client has accepted the applicable proposal or agreement and the required initial payment has been received. Quotes and proposals remain valid for thirty (30) days unless otherwise stated in writing.
4. Payment Terms
Unless otherwise agreed in writing, all projects require a fifty percent (50%) non-refundable deposit before work begins. The remaining balance shall become due upon project completion and prior to the release, transfer, publication, or launch of any final deliverables.
Failure to make payments when due may result in the suspension of services, delayed delivery, removal of access to project materials, or termination of the project until all outstanding balances have been satisfied. The Client agrees to contact BrockStar Websites directly to attempt to resolve any billing dispute before initiating a chargeback or payment dispute with a payment provider. Initiating a chargeback for services that were authorized, performed, delivered, or otherwise provided in accordance with the applicable agreement may constitute a breach of these Terms.
5. Scope of Work and Revisions
Each project includes only those services specifically identified within the approved proposal or agreement. Prior to project completion, the Client may request unlimited revisions to work within the agreed scope. Requests for expanded functionality, additional pages, additional integrations, or services outside the original scope may require additional fees, revised timelines, or a separate agreement.
6. Client Responsibilities
The Client agrees to provide all requested information, content, branding assets, images, credentials, approvals, and other materials necessary for BrockStar to perform its services. The Client further represents that all materials provided are owned by the Client or properly licensed for use.
Failure to provide requested information or timely approvals may delay project completion. BrockStar shall not be responsible for delays resulting from the Client's failure to provide required materials or responses.
7. Intellectual Property
Upon full payment of all invoices, ownership of final custom deliverables created specifically for the Client shall transfer to the Client. Such deliverables may include approved website content, graphics, client-owned domains transferred by BrockStar, and other project-specific materials.
BrockStar retains exclusive ownership of all internal systems, workflows, templates, frameworks, development methodologies, reusable code, software components, business processes, and proprietary tools utilized during the performance of services.
Unless otherwise agreed in writing, BrockStar reserves the right to display completed work within its portfolio, website, social media platforms, and other marketing materials.
8. Third-Party Services
Projects may incorporate third-party software, plugins, APIs, hosting providers, payment processors, CRM platforms, scheduling platforms, themes, fonts, or other external services. Ownership and licensing of these services remain with their respective providers.
If BrockStar registers or purchases a domain name on behalf of the Client, ownership shall transfer upon full payment. Thereafter, the Client assumes sole responsibility for all renewal fees, hosting charges, licensing fees, subscriptions, and other recurring costs associated with maintaining those services.
9. Post-Launch Support
BrockStar's services are provided as one-time projects. Ongoing maintenance, updates, hosting management, and content changes following project completion are not included unless otherwise agreed in writing. For thirty (30) days following project completion, BrockStar will correct, at no additional charge, any defects resulting from its own work.
10. Cancellation
Either party may terminate a project by providing written notice.
If the Client terminates the project after work has commenced, all payments previously made shall remain non-refundable. The Client shall remain responsible for payment of all work completed through the effective date of termination. Ownership of unfinished work shall remain exclusively with BrockStar until payment has been made in full.
11. Refunds
Refunds shall be governed by the BrockStar Websites Refund & Cancellation Policy. Unless otherwise required by law, deposits, completed services, and custom development work are non-refundable.
12. Warranties
BrockStar agrees to perform its services using commercially reasonable care and professional standards. However, BrockStar makes no guarantee regarding search engine rankings, website traffic, advertising performance, sales, lead generation, business growth, or any other specific business outcome.
13. Limitation of Liability
To the fullest extent permitted by applicable law, BrockStar shall not be liable for any indirect, incidental, consequential, punitive, or special damages arising from the use of its services or deliverables, including but not limited to lost profits, lost revenue, business interruption, or loss of data.
BrockStar's total liability arising from any claim shall not exceed the total amount paid by the Client for the specific services giving rise to the claim.
14. Governing Law
These Terms shall be governed by and interpreted under the laws of the Commonwealth of Pennsylvania without regard to its conflict of law principles.
15. Modifications
BrockStar reserves the right to modify these Terms at any time. Updated versions become effective upon publication unless otherwise stated.
